Terms of Service

1. Acceptance of Terms

By creating an account and using Rately, you agree to these Terms of Service. If you do not agree, please do not use our service.

2. What Rately Does

Rately is an automated SMS service that sends review request messages to your customers on your behalf. You provide customer details and we send the messages using your business name and Google review link.

3. Your Responsibilities

• You must have a legitimate business relationship with any customer you send nudges to
• You must only send nudges to Australian mobile numbers
• You must comply with the Australian Spam Act 2003
• You are responsible for obtaining appropriate consent from your customers
• You must not use Rately for any unlawful, harmful or abusive purpose
• You must keep your account credentials secure

4. Pricing and Billing

Rately offers three plans: Starter ($19.99/month), Growth ($29.99/month) and Pro ($49.99/month), all in AUD including GST. The Starter plan includes a 30-day free trial — you will not be charged until the trial ends.

Subscriptions automatically renew monthly. You can cancel at any time from your Settings page. Upon cancellation, you retain access until the end of your current billing period.

5. Refunds

We do not offer refunds for partial months. If you cancel mid-cycle, you retain access until the end of that billing period. If you experience a technical issue caused by Rately, please contact support@rately.au and we will assess refunds on a case-by-case basis.

6. SMS Text Limits

Each plan includes a monthly SMS allowance. Unused texts do not roll over. If you reach your limit, you will need to upgrade your plan to send more nudges that month.

7. Limitation of Liability

Rately is provided "as is". We do not guarantee that using Rately will result in any particular number of Google reviews. We are not liable for any indirect, incidental or consequential damages arising from your use of the service.

8. Termination

We reserve the right to suspend or terminate accounts that violate these terms, particularly around spam or misuse of the SMS platform.

9. Changes to Terms

We may update these terms from time to time. We will notify you by email of any material changes. Continued use of Rately after changes constitutes acceptance.

10. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.
